미국법규는 크게 형법

아동의 성적 착취나 학대에 대해서는 (제2251조~제2260A조52)를 두고 있습니다.
미국 형법은 음란물에 대해서는 이를 제작한 자 뿐만 아니라, 유포한 자도 처벌합니다.
아동 음란물에 대해서는 유포의 개념에 단순 소지 행위와 광고 행위까지 포함하여 강력하게 처벌합니다.

특히, 자체 필터링 프로그램을 활용하여 모든 인터넷 트래픽을 감시하고 있으며, 필터링에 걸리는 용어(인터넷 사용자가 포털 등에서 검색하는 검색어 등)는 즉각 조사에 착수합니다.
‘필터링에 사용되는 용어는 지속적으로 업데이트 되며, 용어의 파괴(예를 들어, ‘자*’ ->‘자z’로 표시하는 등의 방식)를 지속적으로 관찰하여 필터링 용어에 업데이트 합니다.
따라서 자체적으로 실시간 필터링을 하여 성인 사이트에서 신고 하지 않아도 특정 중범죄 성립시 TOS 위반시 법적 처벌 받게 됩니다.
미국 의회는 내용 규제가 아닌 연방정부 지원의 수혜 조건의 하나로 음란물 차단을 위한 기술적 조치를 요구하는 입법을 하였다. 그 중 하나가 CIPA(The Childrens Internet
Protection Act)입니다.
원래CIPA는 통합예산법(Consolidation Appropriations Act)
개정 안으로 발의되었는데, 음란물 필터링은 통신법 제245조(h)에 규정되어 있습니다.
